Welcome to Muse AI Generator, also branded Muse AI Gen. These Terms of Use (the "Terms") govern your access to and use of www.museaigen.com and the AI image and video generation tools, features, and related services we provide (collectively, the "Service"). By accessing or using the Service, you agree to these Terms.

If you do not agree to these Terms, do not access or use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Service Description

Muse AI Generator provides browser-based tools for creating and editing images and short videos. You may submit text prompts, reference images, aspect-ratio choices, and related instructions to create images, edit images, or generate short videos through the models made available on the Service, including Muse Image and Muse Video.

The Service stores task records, reference files, generated results, and related account information so that you can review and download your creations. Features, available models, limits, output formats, and pricing may change over time.

Muse AI Generator is an independent service. Unless expressly stated, it is not affiliated with, endorsed by, or sponsored by any third-party model, infrastructure, payment, identity, or storage provider. Third-party terms and policies may apply to parts of the Service.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent and supervision of a parent or legal guardian.

By using the Service, you represent that you have the legal capacity and authority to agree to these Terms and to comply with applicable laws.

4. User Responsibilities

You are responsible for all prompts, images, files, instructions, and other content you submit to the Service ("Input"), and for how you use images, videos, and other content generated through the Service ("Output").

• Submit only content that you own or have sufficient rights, licenses, and permissions to use.
• Review Output before publishing, sharing, distributing, or relying on it.
• Comply with applicable third-party terms, model policies, and intellectual-property requirements.
• Keep your account credentials secure and promptly notify us of suspected unauthorized access.
• Avoid bypassing safety systems, rate limits, access controls, payment systems, or security measures.
• Avoid interfering with, disrupting, scraping, reverse engineering, overloading, or abusing the Service.

5. Prohibited Content and Conduct

You may not use the Service to create, upload, request, share, or distribute content that:

• Is illegal, harmful, abusive, threatening, harassing, defamatory, hateful, or discriminatory.

We may refuse, remove, block, or limit content or usage that we believe violates these Terms, applicable law, third-party requirements, or the safety of the Service or others.

6. Rights to Input and Output

As between you and Muse AI Generator, you retain any rights you already hold in your Input. You are solely responsible for ensuring that your Input may lawfully be submitted to and processed by the Service.

You grant Muse AI Generator a limited, non-exclusive, worldwide license to host, reproduce, process, transmit, and display your Input and Output only as reasonably necessary to operate, secure, support, and improve the Service, comply with law, and enforce these Terms.

Subject to your compliance with these Terms, you may use Output for personal or commercial purposes. AI-generated images and videos may resemble existing works, people, brands, or styles and may be subject to third-party rights or legal restrictions. You are responsible for determining whether your use of Output is lawful and appropriate.

We do not guarantee that Output will be unique, eligible for copyright protection, accurate, suitable for a particular purpose, or free from third-party claims.

7. AI-Generated Content

AI-generated content may be inaccurate, unexpected, offensive, incomplete, or unsuitable for your intended use. The Service may not always follow a prompt exactly, and similar prompts may produce different results.

Do not rely on the Service for legal, medical, financial, safety-critical, identity-verification, or other professional decisions. You are responsible for reviewing and validating all Output before use.

8. Third-Party Services

The Service uses third-party providers for functions such as AI processing, cloud hosting, database services, object storage, payments, email delivery, sign-in, and abuse prevention. Your Input and related data may be processed by these providers as described in our Privacy Policy.

Third-party services may be subject to their own terms, policies, technical limits, outages, and changes. We are not responsible for the independent acts, omissions, or policies of third-party providers.

9. Payments, Credits, and Usage Limits

Paid features are purchased as one-time credit packs unless otherwise stated at checkout. Applicable pricing, credit amounts, currencies, and taxes are shown before purchase. Payments are processed by third-party payment providers, and we do not store your full payment-card number.

Credits remain on your account until used. If a generation fails, the credits charged for that task are returned automatically. Except where required by law, credits and paid features are otherwise non-refundable after use.

We may apply rate limits, generation limits, file-size limits, content filters, concurrency limits, or other technical restrictions to maintain service quality, safety, and availability.

10. Privacy

Our collection and use of personal information is described in the Muse AI Generator Privacy Policy. By using the Service, you acknowledge that Input, Output, account information, and related data may be processed as described in that policy.

11. Service Availability and Changes

We may modify, suspend, limit, or discontinue all or part of the Service at any time. We do not guarantee that the Service will be uninterrupted, secure, error-free, or available in every location.

We may update models, features, safety systems, pricing, limits, supported formats, storage periods, and provider integrations from time to time.

12. Disclaimer of Warranties

To the fullest extent permitted by law, the Service and all Output are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded in your jurisdiction.

13. Limitation of Liability

To the fullest extent permitted by law, Muse AI Generator and its owners, operators, affiliates, service providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, business, or content arising from or related to your use of the Service.

Our total liability for any claim arising from or related to the Service will not exceed the amount you paid to us for the Service during the three months before the claim arose, or USD 100 if you have not paid us. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Muse AI Generator and its owners, operators, affiliates, service providers, and partners from claims, damages, losses, liabilities, costs, and expenses arising from your Input, your use of Output, your use of the Service, or your violation of these Terms or applicable law.

15. Termination

We may suspend or terminate your access to the Service if we believe you violated these Terms, created risk for the Service or others, or used the Service unlawfully or abusively.

You may stop using the Service at any time. You may also contact us to request deletion of your account, subject to legal, security, payment, and backup retention requirements.

16. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will post the updated Terms on this page and update the Last updated date. Your continued use of the Service after changes become effective means you accept the updated Terms.
